Under Kuwait Labor Law Article 51, the first five years are compensated at 15 days of wages per year.

5 Years × 15 Days = 75 Days of Total Wage Remuneration

Converted to daily wages: Gross Indemnity = 75 × (Monthly Salary ÷ 26) = Salary × 2.8846

Resignation vs Termination at Exactly 5 Years

This is where most employees get confused. Let's break down the exact legal differences:

Scenario A: Employer Termination

You are laid off, contract ended, or non-renewed by employer.

Entitlement: 100% Full Payout
75 × (Salary ÷ 26)

Scenario B: Employee Resignation

You voluntarily hand in your resignation at 5 continuous years.

Entitlement: 50% to 66.67%
Gross × 50% (at 5 yrs) or 66.67% (above 5 yrs)
Crucial Timing Tip: If you resign at 4 years and 11 months, you receive 50%. If you wait until you complete 5 years and 1 day, your resignation multiplier legally shifts to 66.67% (two-thirds)! Waiting just a few weeks can increase your payout by thousands of dinars.
